Discovery

Also called: Examination for Discovery, Disclosure

The pre-trial stage where parties exchange relevant documents and answer questions under oath.

Discovery includes documentary production and examinations for discovery. Parties are generally required to produce relevant documents even when unhelpful to their own case.

Why it matters: discovery is usually the most expensive phase of litigation, and poor document practices before a dispute make it considerably more so.
