Trademark

Also called: Trade-mark, Brand Protection

A sign — a word, logo, or other mark — that distinguishes your goods or services from others.

Rights can arise from use alone in Canada, but registration with CIPO gives nationwide protection and makes enforcement considerably easier. Registration lasts ten years and is renewable.

Why it matters: businesses often build a brand for years before checking availability, only to discover an earlier user or registrant with a superior claim.
